Dans le cadre du règlement d’un recours collectif, est-il approprié ou acceptable de prévoir que le représentant du groupe va recevoir un montant forfaitaire supplémentaire au montant qui va être payé à tous les membres du groupe? D’un côté, il semble normal que celui qui a dévoué temps et effort au nom du groupe soit dédommagé pour ceux-ci. De l’autre côté, il est normal d’être préoccupé de la possibilité que le représentant agisse en son intérêt personnel et accepte un règlement moins avantageux pour le groupe en contrepartie d’un paiement forfétaire.

Il semble qu’après une certaine période d’incertitude, les tribunaux québécois en sont venus à la conclusion qu’un tel paiement est permissible dans le cadre d’un règlement à l’amiable. En effet, dans Petit c. New Balance Athletic Shoe Inc. (2013 QCCS 3569), l’Honorable juge Mark G. Peacock commente la question comme suit:

[48] The law does not provide for the Petitioner to receive any payment in recognition of the time and effort expended in achieving this successful settlement.

[49] However, the Settlement Agreement contemplates the payment of $1,000.00 as a lump sub-payment to the Petitioner in recognition of the time and effort he has expended.

[…]

[54] The Court qualifies the payment of this amount of $1,000.00 not as a fee for services but rather as a symbolic recognition of the work and energy expended by the Petitioner on behalf of the Members. It is reasonable, merited and within the bounds of such honoraria in other cases.

[55] The role of the representative is unique in class action proceedings. The very purpose of the class action is to provide a procedural vehicle so that justice may be rendered where the individual claim is likely so small as to not justify a person taking their own legal proceeding.

[56] In the other cases, the jurisprudence has recognized that quantum meruit amounts may be awarded to petitioners where the amounts in issue are substantial and the effort expended equally substantial.

Il semble donc que, dans la mesure où le montant accordé au représentant est raisonnable dans les circonstances, les tribunaux québécois accepteront d’approuver un règlement qui prévoit un tel paiement.
