Sales Representative Agreement

When communicating with a company's clients, a sales representative acts as a spokesperson for that company. As such, their role is vital and can positively or negatively impact a business's sales. It is, therefore, important to clearly define the duties of the sales representative for the specific context (depending on sector, company, territory, etc.) as well as that person's remuneration.

We have drafted this employment agreement template specifically for the context of a sales representative. Given that the duties of a sales representative differ greatly from those of a regular employee, our general employment agreement templates (C02300 and C02305) would not be suitable.

This agreement template sets out the legal, administrative or financial components relating to the sales representative's responsibilities and must not be confused with the letter of hire (template C02210), which only provides an overview.

Sales Representative Agreement

We recommend using this employment agreement template rather than a letter of hire when the sales representative may directly have a material impact on the activities of the business If so, it is important to define as many aspects of the relationship between the sales representative and the company rather than leaving it to chance.

However, if there exists a collective agreement governing the employee's work conditions, it may be that some provisions of the employment agreement will not be fully enforceable.
